This permission does not in any way constitute a waiver of the need to obtain building permission for this proposed development and any other necessary Government licenses and or permits that may be required.  The applicant is responsible for obtaining all necessary licenses that may be required.

 

2000/0470                  Amendment, Meads Bay (17910 B 59) Krebbers Associates

Refused for the following reasons:

i.                     The proposed amendment is contrary to the Building Act 1974, which requires buildings to have the minimum setback of 6ft from the side boundary.

ii.                   The proposed amendment with an open porch like structure very close to its boundary line would be unsatisfactory because it would result in the loss of privacy to potential occupants of the adjacent parcel of land.

ii.       All matters relating to storm water drainage including the layout and design of the disposal system shall be carried out in accordance with specifications approved by the Chief Engineer of the Department of Infrastructure and completed to his satisfaction prior to the operation of the store in accordance with the terms of this permission.

i.   The development which is proposed to be renovated and further intensified by an additional dwelling unit, is only six feet two inches (6 2) away from the adjoining right of way, instead of the sixteen (16) feet required by the Land Development Control Committee.

ii.    Residents of the development would suffer from an unacceptably low level of amenity due to the location of the apartment building.
