iii.      The proposed use is contrary to the provisions of the Draft National Land Use Plan and Government Policy which shows the area primarily for tourism and not for institutional use.  It is considered that the use of the land for institutional use could be detrimental to the amenity and character of the area.

i.               The proposed building is only 7ft off the Liberty Road instead of the minimum 16ft setback distance required by the Land Development Control Committee for all structures from a public road.

ii.             The proposed building is only 5ft from the back boundary instead of the minimum 16ft setback distance required by the Land Development Control Committee for all structures from a back boundary.

iii.            The proposed number of parking spaces for this development is two (2) spaces instead of five (5) spaces as required by the Land Development Control Committee.

iv.           The proposed development would not provide suitable and sufficient accommodation within the curtilage of the site for parking, loading and unloading of vehicles in connection with the use of the site.  Such development would thus result in the parking of vehicles on the carriage way, thereby increasing the hazards along this section of the road.

Refused for the following reasons:

i.         The area in general has been affected by slope failure. The imposition of additional loading caused by the proposed development can initiate slope instability and consequently slope failure.

ii.       The proposed development would result in the removal of vegetation and increased impermeable surfaces on the site, thus resulting in increased water run off.  This would in turn lead to increased erosion and ultimately slope failure.

iii.      The increased water run off from the hill sides caused by the clearing of vegetation from the slopes, would increase the drainage problems in Sandy Ground.
